This website (clickoccupationaltherapy.com together with the app, the "Site") is operated by Click Occupational Therapy, LLC, ("Company"), a Nebraska Professional Limited Liability Company having a registered agent at Dorwart Law, 7305 Main Street, Ralston, Nebraska 68127. The Services are currently intended for users in the United States. Click Occupational Therapy is a site, platform, and app used for helping Users or Customers receive occupational therapy evaluations, consultation, recommendations and education. Throughout the Site, the terms "we", "us" and "our" refer to the Company. The Site, including all information, tools, goods, and services available to any person using the Site or Services (the "User" or "Customer" or "You/Your") is conditioned upon your acceptance of all terms, conditions, policies and notices stated here without modification. By visiting our Site and/or purchasing products or services from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms"), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all Users of the Site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content. Please read these Terms of Service carefully before accessing or using our Site. By accessing or using any part of the Site, you agree to be bound by these Terms of Service. IF YOU DO NOT CONSENT TO AND AGREE WITH THESE TERMS OF SERVICE AND/OR PRIVACY POLICY, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES, FROM ACCESSING THE SITE, AND YOU MUST DISCONTINUE USE IMMEDIATELY. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service. Company expressly rejects all proposals to modify, delete or amend the Terms. We reserve the right, at our sole discretion, to change, modify, add or remove portions of these Terms of Service, at any time. It is the responsibility of the user to review these Terms of Service periodically for updates / changes before usage of the Services. Your continued use of the Services following the posting of changes will mean that you accept, are aware and agree to be bound by the revisions.

SECTION 1 - SITE TERMS

You may not use our Service, including purchased products, for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms or viruses or any code of a destructive nature. At our sole discretion, we may terminate Your access to the Site and the Service upon any violation of these Terms.

Certain features may request location permissions.

SECTION 2 - GENERAL CONDITIONS

We reserve the right to restrict or deny Your access to the Service based upon any conduct or content posted by You that, determined at our sole discretion, is harmful or not safe to the Site or to any other User. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any content on the Site through which the service is provided, without express written permission by Us. Users of the Site must be eighteen (18) or older. You agree to notify us immediately of any actual or suspected breach of Your Service account or unauthorized use of Your account information. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

These Terms of Service are an electronic record, published in accordance with applicable law and do not require physical or digital signatures.

Eligibility and Registration:

The Services are intended for use by individuals aged 18 (eighteen) years or above. By accessing or using the Services, you represent and warrant that you meet this eligibility requirement.

We do not run background checks. 

At the time of onboarding, we may request certain details from you, including but not limited to your name, email address, phone number, and other personal data. You are responsible for providing true, accurate and complete information and updating it by informing us, whenever needed.

Users agree to use the Services solely for lawful purposes and in a manner consistent with these Terms of Service and any applicable laws.

Access to Services and Interruptions:

Subject to your compliance with the terms and conditions of these Terms of Service, our Privacy Policy, applicable laws and any other documentation, guidelines and/or policies we make available to you, we hereby grant to you a limited, non-exclusive, non-transferable, non-sublicensable revocable license, to access and use the Services.

We strive to ensure that the Services remain accessible to users at all times. However, we do not guarantee uninterrupted or bug/error-free access and may modify, suspend, or terminate the Services, whether partly or fully, without prior notice. Users agree that we are not liable for any losses, damages, inconvenience, disruptions or modifications that may affect the availability of the Services. Nothing in these Terms of Service will be construed to obligate us to maintain and support the Services or to supply any corrections, updates, or releases in connection therewith.

SECTION 3 – ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We shall not be liable to any User if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the basis for making any life decisions, medical decisions, general decisions, health or lifestyle decisions without consulting primary, more accurate, more complete or more timely sources of information including licensed medical professionals or other professionals. Nothing on the Site and no part of the Services are provided to the User as medical advice in any way, and any information related to physical or mental health obtained from the use of the software through the Site is simply informational. The Company does not verify or warrant the accuracy, safety, or legitimacy of content, information, recommendations, or promotions on the Site. Any reliance on the material on this site is at Your own risk. This Site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this Site at any time, but we have no obligation to update any information on our Site. You agree that it is your responsibility to monitor changes to our Site.

SECTION 4 - PRICES AND PAYMENT

Current subscription plans, flat fees, and pricing, as applicable, will be made available on the Site prior to purchase.

Subscriptions and Auto-Renewal. If you purchase a recurring subscription, you authorize the Company (or our third-party payment processor) to automatically charge your payment method on a recurring basis (for example, monthly or annually) at the then-current rate until you cancel. You may cancel your subscription at any time through your account settings on the Site or by contacting [__________________]. To avoid being charged for the next billing cycle, you must cancel before your current subscription term renews. We will provide notice of any material changes to subscription pricing or terms as required by applicable law.

If you initiate a payment dispute or chargeback, the dispute process is governed by your card network/bank and handled through the payment processor. The Company may share relevant transaction data and communications with the payment processor and other involved parties for dispute resolution. Excessive or abusive disputes/chargebacks may result in account suspension or termination.

Payment in full is required at the time of purchase and shall be made in US currency by any means indicated by the Company as acceptable at the point of sale. By providing a credit card, debit card or other payment method that Company accepts, User represents and warrants that User is authorized to use the tendered payment method and that Company (or its third-party Payment Processor) is authorized to charge the tendered payment method for the total amount of User's purchase, including any applicable taxes and other charges. We are not responsible for errors made by Stripe or service providers.

Force Majeure. The Company shall not be liable or responsible to any party, User, nor be deemed to have defaulted under or breached this Agreement, for any failure or delay in fulfilling or performing any term of this Agreement when and to the extent such failure or delay is caused by or results from acts beyond the impacted Party's ("Impacted Party") reasonable control, including, without limitation, the following force majeure events ("Force Majeure Event(s)") that frustrates the purpose of this Agreement: (a) acts of God; (b) flood, fire, earthquake or explosion; (c) war, invasion, hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest; (d) government order or law; (e) actions, embargoes or blockades in effect on or after the date of this Agreement; (f) action by any governmental authority; (g) national or regional emergency; (h) strikes, labor stoppages or slowdowns or other industrial disturbances; (i) epidemic, pandemic or similar influenza or bacterial infection (which is defined by the United States Center for Disease Control as virulent human influenza or infection that may cause global outbreak, or pandemic, or serious illness); (j) emergency state; (k) shortage of adequate medical supplies and equipment; (l) shortage of power or transportation facilities; and (m) other similar events beyond the reasonable control of the Impacted Party.

SECTION 6 - PRODUCTS OR SERVICES

The following are products or Services that are available through the Site:

Occupational therapy recommendations and third-party service provider recommendations. 

SECTION 7 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

You agree to provide current, complete, and accurate account, billing, and purchase information for all transactions made through the Services. You agree to promptly update Your account and other information, including Your email address and any billing or payment-method information needed to complete transactions through our payment processor, so that we can complete Your transactions and contact you as needed.

SECTION 8 - OPTIONAL TOOLS

The Site may provide You with access to third-party tools over which we neither monitor nor have any control nor input.

YOU ACKNOWLEDGE AND AGREE THAT WE PROVIDE ACCESS TO SUCH TOOLS "AS IS" AND "WITH ALL FAULTS" WITHOUT ANY WARRANTIES, REPRESENTATIONS OR CONDITIONS OF ANY KIND AND WITHOUT ANY ENDORSEMENT. WE SHALL HAVE NO LIABILITY WHATSOEVER ARISING FROM OR RELATING TO YOUR USE OF OPTIONAL THIRD-PARTY TOOLS. ANY USE BY YOU OF OPTIONAL TOOLS OFFERED THROUGH THE SITE IS ENTIRELY AT YOUR OWN RISK AND DISCRETION AND YOU SHOULD ENSURE THAT YOU ARE FAMILIAR WITH AND APPROVE OF THE TERMS ON WHICH TOOLS ARE PROVIDED BY THE RELEVANT THIRD-PARTY PROVIDER(S) AND HOSTS.

We may also, in the future, offer new Services and/or features through the Site (including, the release of new tools and resources). Such new features and/or Services shall also be subject to these Terms of Service.

Certain content, products and services available via our Service may include materials from third-parties. Third-party links on this site may direct You to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites or YouTube embedded materials or content, or for any other materials, products, or services of third-parties. We are not liable for any harm or damages related to the purchase or use of Services, resources, content, or any other transactions made in connection with any third-party websites or with any third-party. COMPANY DISCLAIMS ANY WARRANTY NOT EXPRESSLY PROVIDED HEREIN AND ANY IMPLIED WARRANTY, GUARANTY OR REPRESENTATION AS TO PERFORMANCE, QUALITY AND ABSENCE OF HIDDEN DEFECTS, AND ANY REMEDY FOR BREACH OF WARRANTY OR CONTRACT, WHICH BUT FOR THIS PROVISION, MIGHT ARISE BY IMPLICATION, OPERATION OF LAW, CUSTOM OF TRADE OR COURSE OF DEALING, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

You agree that from time to time we may suspend or discontinue the Service for indefinite periods of time or cancel the Service or the Site at any time, without notice to You. You expressly agree that Your use of, or inability to use, the Service and the Site is at your sole risk.

THE SERVICE AND ALL PRODUCTS AND SERVICES DELIVERED TO YOU THROUGH THE SERVICE ARE (EXCEPT AS EXPRESSLY STATED BY US) PROVIDED 'AS IS' AND 'WITH ALL FAULTS' FOR YOUR USE ACCORDING TO THE TERMS.

In no case shall Company, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from Your use of any of the Service or any products procured using the Service, or for any other claim related in any way to Your use of the Service or any product. Any liability by the Company for damages shall be limited to the purchase price for the Services ordered. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for certain claims and damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law. 

However, no content or information on the Site, no recommendations on the Site, and no promotions on the Site are to be used, construed, or held out as medical, psychological, psychiatric, religious, or legal advice, counseling, or therapy whatsoever.

Further, the Site does not provide medical, psychiatric, or psychological diagnosis. If crisis-related or triggering language is flagged by the Company in either posts, chats, or conversations, the Company may display crisis resources within the Services (such as the 988 Suicide & Crisis Lifeline or 911) and may flag and log such interactions internally for safety purposes. The Company does not guarantee detection of crisis language, does not provide diagnosis or clinical assessment, is not a medical or mental health provider, and disclaims all liability whether or not it detects, flags, displays resources for, or takes any other action regarding such posts, chats, or conversations.

Users agree not to rely on recommendations, content or information, or promotions provided by the Site for medical, physical, therapeutic, occupational therapy, psychiatric or psychological, mental health or emotional and mental well-being, life advice or legal advice.

We disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and any warranties arising out of course of dealing or usage of trade. We make no warranty that any of the Services will meet your requirements and/or that the Services will be uninterrupted, timely or error-free, nor do we make any warranty as to the results that may be obtained from the use of the Services or the accuracy of any other information obtained through the Services. You understand and agree that any material and/or data downloaded or otherwise obtained through the use of any of the Services is done at your sole risk and that you will be solely responsible for any damage to your computer system and/or loss of data that results from the download of such material and/or data.


Our Services are for informational and awareness purposes and the information provided on the Services are not intended and/or should not be used to ascertain or deduce any medical diagnosis for treatment, cure, mitigation, or prevention of any medical condition. The Services are NOT intended for: (i) diagnosis, counselling, prevention, monitoring, treatment or alleviation of any disease or disorder; (ii) diagnosis, monitoring, treatment, alleviation or assistance for, any injury or disability; (iii) investigation, replacement or modification or support of the anatomy or of a physiological process;(iv) supporting or sustaining life; (v) disinfection of medical devices; and/or (vi) control of conception.

You understand and agree that any assessments or patterns derived by us based on the information collected from the Services do not constitute medical advice or substitute medical advice. We do not provide medical advice or consultation in the capacity of a health care services provider. Our role is limited to collating, extracting, and reproducing data derived from the inputs provided by the user. 


In case of a medical emergency, noticing a medical anomaly or a medical condition, you should consult a licensed health care provider and not rely on any information provided by us via the Services. Do not start, alter, stop or otherwise substitute taking any medication or medical treatment based on the information provided on the Services, unless advised by a medical practitioner, and/or delay seeking any medical advice. You assume sole responsibility for your decisions and actions in relation to your health and understand that we shall not be liable for any decision taken by you by relying on the information provided on the Services.

SECTION 13 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless Company and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of Your breach of these Terms or any other claim related to or arising from Your use of the Service. 

SECTION 14 – SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 15 - TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, closing Your Service account and discontinuing use of the Site and the Services. Company may, at its sole discretion, terminate Your access to the Service and close Your Service account at any time for any reason.

SECTION 16 - NO WAIVER

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

SECTION 17 - GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of the State of Nebraska without regard to conflict of law principles. The Vienna Convention on the International Sale of Goods (CISG) shall not be applicable and is expressly disclaimed.

In the event the Parties are not able to resolve any dispute between them arising out of or concerning this Agreement, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act and in accordance with the American Arbitration Association rules then in effect, conducted by a single neutral arbitrator and administered by the American Arbitration Association in the jurisdiction of Omaha, Douglas County, Nebraska. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction.

Except as otherwise required by applicable law or the applicable AAA Consumer Rules, each party shall bear its own attorneys' fees and costs, and the arbitrator may award attorneys' fees or costs only to the extent permitted by applicable law.

You may opt out of this arbitration provision by sending written notice of your decision to opt out to the email address listed in Section 21 within 30 days after your first acceptance of these Terms (or account creation).

Either party may bring an individual action in small claims court, instead of arbitration, if the claim qualifies for small claims court in the applicable jurisdiction.

Arbitration fees and costs will be allocated in accordance with the applicable AAA Consumer Rules and applicable law, and nothing in this Section requires a consumer to pay more than those rules or applicable law allow.

CLASS ACTION WAIVER. You agree to waive any consolidated, class action, or joint claims and to resolve all claims individually through binding arbitration. If this class, consolidated, or joint action waiver is found unenforceable as to any claim or request for relief, then that claim or request for relief shall proceed in court and not in arbitration.

SECTION 18 - CHANGES TO TERMS OF SERVICE 

You can review the most current version of the Terms of Service at any time on this page. We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms, by posting updates to our Site, app, or Services, or by otherwise providing notice as required by applicable law. It is Your responsibility to check the Services periodically for changes. Unless we state otherwise, changes apply prospectively from their effective date, and Your continued use of or access to the Services after the effective date constitutes acceptance of those changes.

Notwithstanding the foregoing: (a) no update will retroactively reduce amounts validly earned before the effective date of the update, subject to refunds, chargebacks, failed payments, fraud, abuse, and other adjustments expressly permitted under these Terms or a signed agreement; (b) no update will override express economics set forth in a separate signed agreement with Click Occupational Therapy, except as expressly allowed in that signed agreement.

2. Information We Collect

A. Information You Provide

  • Account information. Name, username, email address, phone number (used for one-time-password verification), and password.

  • Profile information. Bio, profile image, interests, practices, languages, cultural or community descriptors, and anything else you add to your profile.

  • Location you enter. City, state, or region you type during registration or in your profile.

  • Device location (optional). Certain features, particularly on mobile, may request permission to access your device’s location. If you grant permission, we may collect approximate or precise device location to enable features such as finding nearby events or sharing your location with other users. You can revoke permission at any time through your device or browser settings.

  • Booking and transaction information. Subscription details, purchases, bookings, and related records. Payment card data is collected and processed directly by Stripe and is not stored on our servers.

  • Support and communications. Questions, support tickets, emails, survey responses, and feedback.

  • Calendar or integration data. If you connect a calendar service such as Google Calendar, Microsoft, or Apple Calendar for booking or scheduling.

Depending on how you use the Services, the information you provide may include details about your wellness, emotional state, practices, or beliefs. Please share only the information you are comfortable with us processing.

B. Information Collected Automatically

  • Device and browser data. IP address, device identifiers, browser type, operating system, app version, language settings, and approximate location inferred from your IP address.

  • Usage and behavioral data. Pages viewed, features used, time spent, clicks, referral URLs, and engagement patterns. In-app behavioral analytics cannot currently be disabled while using the Services.

  • Log and diagnostic data. Crash reports, performance data, error logs, and troubleshooting records.

  • Cookies and similar technologies. Identifiers and activity information collected through cookies, SDKs, local storage, or similar technologies.

C. Information From Other Sources

  • Payment processors. Stripe provides transaction confirmations, payout status, refund and dispute data, and limited payment identifiers.

  • Embedded content providers. YouTube, Vimeo, and similar platforms may provide metadata when you interact with embedded content.

  • Service providers. Vendors that help us operate, secure, analyze, or improve the Services.

3. How We Use Your Information

We use personal information to:

  • provide the Services, including accounts, profiles, messaging, bookings, and subscriptions;

  • personalize your experience, including content based on your activity, preferences, and the location you provide or permit us to access;

  • operate AI-powered tools and recommendations;

  • process payments, payouts, refunds, chargebacks, and subscriptions through Stripe;

  • moderate content, investigate reports, enforce our Terms, and protect the safety and integrity of the Services;

  • detect and prevent fraud, abuse, harassment, and unauthorized access;

  • communicate with you about your account, bookings, support requests, safety issues, transactions, and policy updates;

  • send marketing or promotional communications where you have opted in;

  • analyze usage, improve features, debug issues, and develop new functionality;

  • create aggregated or de-identified insights and analytics; and

  • comply with legal obligations and protect our rights, users, hosts, and the public.

5. Location sharing. Certain features may allow you to share your location with other users. Location sharing is always optional and can be disabled through your account or device settings.

We may review user content, messages, and community activity when necessary for moderation, safety, legal compliance, or enforcement of our Terms.

6. Location Information

We collect location information in two ways:

  • Location you enter. City, state, or region you provide at signup or in your profile. 

  • Device location (optional). Certain features, particularly on mobile, may request permission to access your device’s location through your browser or mobile operating system. If you grant permission, we may collect approximate or precise device location to enable features. You can revoke permission at any time through your device or browser settings. Features that depend on device location may not function fully if you decline or revoke permission.

We do not continuously track your background location. We do not sell or share your precise location data with third parties for their own advertising purposes.

7. Payments and Financial Information

Payments and payouts are processed by Stripe and Stripe Connect. Click Occupational Therapy does not store your full payment card number on its own servers. We receive transaction confirmations, payout records, subscription status, refund and chargeback data, and limited billing identifiers from Stripe.

We may share relevant transaction data and related communications with Stripe, hosts, and other involved parties to process payouts, refunds, chargebacks, disputes, fraud prevention, and support requests.

8. Cookies, Analytics, and Marketing

We use cookies, SDKs, and similar technologies to operate the Services, keep you signed in, remember preferences, measure traffic and engagement, monitor performance, debug issues, and improve features. Our analytics tools may include Google Analytics, Firebase, and related services.

In-app behavioral analytics, such as page views, clicks cannot currently be disabled while using the Services. You can manage cookies through your browser settings, but disabling certain cookies may affect functionality.

We send marketing emails only to users who have opted in. You can opt out at any time by clicking “unsubscribe” in any marketing email or updating your account settings. Opting out of marketing does not affect service-related communications.

We do not currently use third-party advertising cookies, retargeting pixels, or cross-context behavioral tracking on the Services.

Our Services do not currently respond to browser “Do Not Track” signals. However, we process Global Privacy Control (“GPC”) signals as opt-out requests where required by applicable law. Some third-party analytics or embedded content providers may collect information about your online activities over time and across different online services when you use the Services or interact with embedded content, subject to their own terms and privacy policies.

9. How We Share Your Information

We do not sell your personal information. We do not share personal information for cross-context behavioral advertising as those terms are defined under Nebraska law.

  • For legal reasons. We may disclose information if required by law, regulation, or legal process, or to protect the rights, safety, or property of Click Occupational Therapy, our users, or others.

  • In business transfers. If Click Occupational Therapy is involved in a merger, acquisition, sale of assets, or bankruptcy, personal information may be transferred as part of that transaction. We will notify you of any such change.

  • With your consent. We may share information for other purposes with your direction or consent.

11. Data Retention

Disclosures to Service Providers and Contractors

We disclose this information to providers of hosting and infrastructure, payment processing (Stripe), analytics (Google Analytics, Firebase), email delivery (MailerLite), error tracking, and safety and moderation services.

We use sensitive personal information as reasonably necessary to provide the Services, maintain safety and security, process transactions, comply with law, facilitate user-selected features such as optional location sharing, and work with service providers and contractors that help us operate the Services. We do not use sensitive personal information for advertising or cross-context behavioral advertising.

California residents may have the following rights, subject to applicable exceptions:
